Here in Norfolk and most of VA, emissions is not a part of the inspection.
Up yonder is NOVA, it is. A friend of mine up there told me that "some" stations just plug into the OBD-II port and see if there are any emissions related DTCs there. But.... He said some stations actually put the car on rollers with a tailpipe sniffer. Actually not sure how accurate that is.
I have tuned a number of people up there and turned off the DTCs related to not having a CAT, specifically the P0420 code. Each and every one of them passed without issue.
From what I hear from them, just make sure you DON'T go to a station that does the sniffer test.

Power gain..... Depends upon so much other stuff.... A good high flow cat today will be pretty close to catless.
Anyhows.... Yes, the DTC can be turned off. I've done it on numerous cars that have passed NOVA inspection without issue.
