You should ask him what SS options is acutally has... My thinking, badges only. I'd report his reply to EBay and false advertising.

EDIT: I reported him to EBay and also sent him an email stating false advertising that SS badges does not make it an SS.

You can only report it. If you look to the right side of the listing there is a hyperlink to report bad listings.
