More dents for DentedHHR!!!!! (video inside)

Oh WOW!!!!! Neighbor hops in her car, mad at her boyfriend, backs out of driveway and side-swipes my HHR......I've slowly been doing all the body repairs my self, taking out dents & dings. Almost had the car ready for paint........these new dents are a MAJOR setback. The rear passenger door wont even open. Local wrecking yard has one HHR with good mirror, doors, headlight and fender......don't know what the heck I'm gonna do about the gas filler door, quarter panel or the door jamb. I have State Farm insurance and I ain't worried about my side of things.......but the neighbor is saying I'm responsible because my (parked) car was in her "blind spot". Neighbor lady has the bare minimum insurance coverage a person could get.

Thinking I'M THE ONE WHO SHOULD BE MAD at her because now I have to pay $500 for my insurance deductable. She doesn't even have a license. Luckily I have full, gap, uninsured, unlicensed, under insured coverage.

Some peoples kids!!!!

Oh, so you are responsible for your neighbors negligence? In insurance there is no such thing as a "blind spot", it is an area that the driver failed to see.

If you were legally parked it is 100% the other drivers (owner of the vehicle) fault.

She has full responsibility, if she balks at paying, hire a law firm and get them to go get her!
She is driving, she is responsible to check her blind spots and be in control of her vehicle!
You can fix the dents but you can’t fix stupid, and her driving in a blind rage was stupid.
I bet she was in her phone texting her friends at the time.

"the bare minimum" insurance covers you, not her. If it does not pay you in full then your insurance company will take them to court.

Did this happen on a public road or a parking lot? If on a public road you need to get a police report.

I also believe the deductible does not apply when using the uninsured motorist provisions of your policy.

A few years ago I backed into the neighbor girls 2 week old dark blue Mustang with my farther in laws LHS. It was a dark night the street light down the block was out and it was raining when I hit her car. I simply couldn't see it in the dark like that.

The father in laws car got a bit of scratching on the rear bumper, the Mustang got the drivers side door dented in. The girl said not to worry about it and wanted to just leave. I had already called the police when I saw her coming out to go.

She went back inside and got a plunger and tried to suck the dents out with that. The cops told her to stop doing that while they took photos and statements. She was pissed at them for keeping her. She had been drinking and whatever else inside the house.

Within a few days her car looked like new again but was no longer dark blue, she had them paint it bright 'safety' yellow.

As stated it was my farther in laws car but I was driving so my insurance had to foot the bill. It was indeed my fault but I did not have to pay for the color change of her car in the end. She had Farmers Mutual and I had State Farm. I think the insurance companies had a good time with it. She still speaks nicely to me.

I called the California State Highway Patrol and asked them what I should do. They said to contact local police department and have an officer come out to make a police report regarding the accident. I then called city PD and they asked, "Did the collision occur on public roadway and were there any injuries"?. I said, No this happened in a shared parking area between mine and my neighbors house. There are no injuries. The police then told me that because there were no injuries and the collision occured on private property, there is nothing they will do about.

I mentioned that the neighbor lady didn't have a valid drivers license.................Doesn't matter the police said............because she was still on private property.

So the police can't do anything, the insurance company must.

Evidently nobody has explained insurance to you. The minimum insurance required is to protect the OTHER car and driver. Comprehensive (the optional) is meant to protect a) the lien holder or b) yourself.

Your insurance needs to be notified, but they are not responsible for anything unless you choose to exercise your uninsured coverage. The other driver is responsible for ANY damage.(period). In some instances your insurance will pay for damages then subrogate (sue the other party/company for reimbursement).

If this happened on private property there may be a basis for a homeowners claim.

What you need to do is contact the other insurance company, if the owner refuses to, and make a claim. Or, you can just pay your deductible and walk away feeling wronged.

You could be a nice guy and let your neighbor or his gal pay the deductible and have the accident go against your insurance record. Remember any claim paid by an insurance company gets marked up to the policy owner's account, it could lead to a denial of coverage.
