Not saying this isn't true. But, I have researched and researched and can't find a Federal Law that states this is necessary.
I think it's just a matter of safety concern (and possibly economics)by the respective manufacturers. Not for the need to keep the exhaust emission from the fuel filler but, to prevent a HOT EXHAUST pipe from doing possible harm to the tank, filler and peripheral fuel apparatus (take a look underneath your HHR, or for that matter any car, and notice the routing of each item).

Anyone remember where the gas tank filler spout was on a 1956 Caddiliac DeVille? (Hint, it was NOT behind the rear license plate...)

And when I worked in a gas station in high school, I didn't know that and on my first day, all the other attendends just laughed as I tried to find the gas cap. I finally ask the lady driving the car and she said, "I have no idea, you folks always take care of that." The other guys just laughed and laughed.
NOTE TO YOUNG FOLKS: Back in the 50's and 60's, you never pumped your own gas, service station attendants did it for you. See the first "Back To The Future Movie" when McFly arrives back to 1958 and he sees a car drive into a filling station. THAT was what it was like. We pumped gas, clean the windshield, checked the oil and checked the tire pressure....it truly WAS a service station!
