Flex Pipe and Emissions Warranty

OK I have a HHR that started running poorly. I discovered the flex pipe was bad. The car now also has a engine light on code P0171 again pointing to the air getting into the exhaust. I also had a surfer smell for a number of days.
My understanding is for major emissions components, EPA requires a 80,000 or 8 year warranty. As the flex pipe is part of the Converter, it stands to reason this is to be covered by law.
However our local dealership is denying to cover it under the emissions warranty claiming that they will only warranty it if I have a Catalyst System Efficiency code which would be PO420. They are claiming GM warranty won't cover it without the efficiency code.
This is the second time they have denied a valid warranty claim on this vehicle. I am beyond pissed off with these people.
Anyone from a GM dealership here that can give me any light on the matter?

Try another dealership and tell them straight up!

Sorry meant sulfur smell, I'm sure you knew that and was just messing with me though :P

Lawdog88, are you an attorney? This isn't my first time with a problem with this dealership not covering a warranty item. I see your from MI. This is a Michigan Dealership in the Brighton Area.

It is basically the service departments call, some do some don't. Don't limit yourself to Chevy dealers BTW any GM dealer can do it. However don't go in throwing codes around, tell them you think your cat is leaking, let them do the thinking. You may not say the correct key words.

I managed to confuse my Chevy dealer parts dept so bad that they paid me take it off their hands. I bought it with core deposit, returned the core and they credited me the entire invoice back.
